TERMS OF SALE
ARTICLE 1 - ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE (GTCS)
These General Terms and Conditions of Sale (GTCS) apply to all sales concluded through the Site.
The GTCS constitutes a contractual agreement between the Buyer and Safia Ouares.
The acquisition of a Product via the Site implies an unreserved acceptance of the GTCS by the Buyer.
Safia Ouares retains the possibility of modifying these GTCS at any time in order to comply with any new regulations or in order to improve the use of the Site. As a result, the applicable GTCS will be those in force on the date of the order by the user.
ARTICLE 2 – ORDER
You can buy on the Site the Products that will be shipped by either Colissimo or Chronopost upon receipt of your payment.
Before paying the order, the Buyer can check all the terms and conditions of his purchase and then click on "Validate and pay my order".
Once your order is completed on the Site, a confirmation email summarizing all the terms and conditions of the purchase will be sent to the Buyer.
The Products are sold at the price indicated on the Site. They are available within the limits of available stocks.
When ordering, the Buyer will have the choice between different shipping categories, with specific financial conditions. Before validating his order, he/she will be able to check the price of the selected Products and the cost of the chosen delivery.
In case of unavailability of all or part of the order, a refund will be made by credit on the bank account of the Buyer, at the latest within 30 days from the payment of sums paid by the Buyer.
The Site reserves the right to cancel any order from the Buyer with whom there is a dispute over the payment of a previous order.
ARTICLE 3 - PRICE
Rates and prices featured on the Site are net, all taxes included (VAT included), subject to change depending on the rate of VAT.
Prices are quoted in euros and do not include shipping costs.
No order will be shipped without the full payment (shipping included) of the order. The payment will be fully charged at the time of processing the order.
In case of an order to another country outside of France, any customs duties or other local taxes or import duties or state taxes are the responsibility of the Buyer.
ARTICLE 4 - DELIVERY
All Products are carefully packaged by hand. Once purchased, each Product is wrapped with paper and placed in a box with adequate coverage to protect the Products from any damage during shipment.
The delivery costs correspond to the shipping costs depending on the chosen option (Colissimo or Chronopost) and the geographical area of destination.
Our deliveries are ensured by La Poste (Colissimo or Chronopost).

The delivery time of La Poste is included:
- between five and ten days for a shipment to metropolitan France and the European Union
- between ten and twenty days for a shipment to the Dom-Tom or other countries.
Delivery times are calculated from the date of receipt of payment.
Products are sent to the delivery address that the Buyer has indicated during the ordering process.
International orders are also shipped via La Poste - Colissimo or Chronopost parcel solutions, and usually take between 1-2 weeks to arrive depending on stock availability and customs processing.
Your tracking number will be sent to you as soon as your order is ready to be sent. You will be requested to sign upon reception of your package.

Upon delivery, it is your responsibility to make sure the parcel is in good shape and its content has not been damaged. Do not sign a delivery slip if your order is damaged, as no claims will be honored if the delivery slip has been signed.
In case of a problem, please return the parcel to the shipping company within 15 days of reception and require that they write down the nature of the complaint. On the same day, please contact our customer service at safia@safiaouares.com. The Product will be refunded or replaced depending on stock availability as soon as we receive the returned parcel back.
ARTICLE 5 - PAYMENT METHOD
Once the order has been validated, the Buyer pays online using one of the following secure payment methods : STRIPE or via a bank transfer.
Secure payment via credit card is made online via STRIPE. To pay with a bank wire transfer, please contact us at: safia@safiaouares.com. Once your payment has been processed, an invoice will automatically be issued and emailed to you.
ARTICLE 6 - TITLE RETENTION
The Site retains full ownership of the Products sold until the full payment of the price, in principal, fees and taxes included.
ARTICLE 7 - RETRACTION
Under Article L.121-18 of the Consumer Code, the Buyer has a period of fourteen working days from the delivery of his order to exercise his right of withdrawal and thus return the Product to Site for exchange or refund without penalty, except for the costs of return.

The Product must be returned in is perfect original condition, in its original wrapping. The return parcel must be properly insured and trackable. Shipping fees are paid by the customer.
ARTICLE 8 - INFORMATION AND FOLLOW-UP OF YOUR ORDER
Any order processed and validated on the Site is the subject of an acknowledgment of receipt by e-mail. For any question, the Buyer can send us an email to safia@safiaouares.com
ARTICLE 9 - INTELLECTUAL PROPERTY
All elements of the Site are protected by copyright. As such, any reproduction, representation, use, adaptation, modification, incorporation, translation, marketing, partial or complete elements contained in the Site, without the prior written permission of the author, is prohibited.
ARTICLE 10 - GUARANTEE
All claims, requests for exchange or refund must be mailed to the following address :

within the legal deadlines.
As part of the legal guarantee of conformity, Safia Ouares agrees to the choice of the Buyer:
- To replace the Product with an identical Product depending on available stocks,
- To refund the price of the Product if the replacement of a Product proved to be impossible.
ARTICLE 11 - LIABILITY OF THE SITE
The Site can not be held responsible for the use made by the Buyer of the Products purchased on the Site.
The Site can not, in any way be held responsible in the event of an interruption of the Internet network, server failures or electrical problems, of any nature whatsoever, for any reason whatsoever.
For all damages, except cases of fraud or willful misconduct on his part, the liability of the Site to the Buyer under any guarantee or on any basis, is limited to the amount actually collected by the Site in consideration for the Products sold that gave rise to the incident that led to the bringing into play of his liability.
ARTICLE 12 - RESPONSIBILITY OF THE BUYER
Buyer agrees to purchase Products on the Site in accordance with the provisions of these GTCS.
The Buyer who browses the Website is solely responsible for the use he/she makes of the Site, the information it contains and the Products it buys.
The Buyer undertakes to use the Products with discretion, in accordance with the laws in force in France.
Therefore, the Site cannot, in any case, be held responsible for the wrongfulness, the inaccuracy or the inadequacy of the information transmitted via the Site by the Buyer.
ARTICLE 13 - PERSONAL DATA
The Site does not collect, store or share personal data via this service.
ARTICLE 14 - DISPUTE RESOLUTION
The conclusion, the interpretation and the validity of the GTCS are governed by French law.
The jurisdictions of the Cour d’appel de Justice de PARIS are competent to know of any dispute relating to the present GTCS, including, without this enumeration being limitative, any litigation relating to their validity, their interpretation, their execution and / or their termination and consequences.
The present clause will be enforced, even in the case of interlocutory proceedings, cross-claims, multiple defendants or in the event of a warranty claim.
